These are the Terms and Conditions governing the supply of our products ( “ Products ” ) listed on our website www.l oferperfumes.com ( “ our site ” ) to you. Please read these terms and conditions carefully before placing an order on our site . Use of our site indicates your acceptance of these terms and conditions as well as the privacy policy here and the Terms of Use here, whether or not you have chosen to register with our site. www.l oferperfumes.com is operated by BESSAMIM ( “ We ” ) . We are a company registered in FRANCE under number 895305142. Our registered office is located at 9 Rue Parrot, 75012 Paris, France . 2. AVAILABILITY OF SERVICES
There are some restrictions in place regarding the extent of countries we accept orders from. These restrictions can be found on the ' Deliveries ' page here.
3. YOUR STATUS
1. You may only purchase Products from us if:
1. you are legally able to enter into a binding contract with us. (for example, in France, you must be of legal age);
2. you are the authorized user of the credit or bank card used to pay for your order ; and,
3. you reside in a country served by our delivery services (see the “ Deliveries ” page here for more information ).
4. HOW THE CONTRACT IS MADE BETWEEN YOU AND US
1. Once you have placed your order , you should receive an email from us telling you that We have received your order (but please contact us if you do not receive this email). Please note that this does not mean that your order has been accepted . All orders are subject to availability and our approval (which We may not give for any reason ).
2. When you place your order, we will immediately contact your bank or card issuer to obtain authorisation to take payment from your account. We will not process your order until payment has been received in full . If we accept your order, we will confirm this by sending you a further email stating that the Product is being processed for dispatch , at which point the contract between us ("Contract" ) is formed .
3. As soon as you place an order, we will begin processing your order, which means you will not be able to change it until delivery. However, you may return your Products in accordance with clause 8 of these Terms and Conditions or our Returns Policy.
4. From time to time, we may make minor changes to a Product to reflect changes in applicable laws and regulatory requirements .
5. These General Conditions , as well as any Contract binding us, are exclusively in French. Please note that We do not necessarily keep a copy of your Contract. We advise you to keep a copy of these general conditions and your order .
5. DELIVERY
1. Your order will be processed before the delivery date stated in the Dispatch Confirmation or , if no date is specified , as soon as possible (depending on the delivery service you have selected ) . In any case, delivery will take place within 8 days of the conclusion of your Contract.
2. If no one is present at your address to take delivery and the Products cannot be left through your letter box or in a secure place after three attempts, we may end the Contract and clause 13 will apply .
3. Delivery of your order will be completed when We have delivered the Products to the address you have provided and the Products will then become your responsibility .
4. You will own the Products once We have received payment in full .
5. The images of the Products on our site and in our other marketing materials are for illustrative purposes only . Your Products may vary slightly from these images. Although We make every effort to display and print the colours of the Products accurately , We cannot guarantee that your computer's display of colours or images in our other marketing materials accurately reflects the colours of the Products that will be delivered to you .
If you wish to dispute the delivery of your order, you have 14 days from the day the tracking status of your order is updated by the carrier as fulfilled ( i.e. updated as delivered to the address indicated in the shipping confirmation ) to do so . We reserve the right to request supporting documentation, before proceeding with any refund of the price paid and /or associated delivery costs .
6. PRICE AND PAYMENT
1. The price payable for the Products is as set out on our site in Euro. However, please see clauses 7.5 and 7.6 for what to do if We discover a pricing error in the Products you order. The prices shown on our site do not include delivery charges which are payable in addition and displayed separately during the checkout process.
2. We may change the prices on our site at any time without notice but changes will not affect orders already accepted .
3. We accept payment by bank card, credit card , Paypal. We accept the following cards: Visa, VISA Electron, Mastercard, Maestro, American Express.
4. You must pay for the Products (including any applicable delivery charges ) and We will charge the card you have chosen to pay for your order on the final billing page after you submit your order. We will immediately contact your bank or card issuer to obtain authorisation to take payment from your account.
5. If you wish to use a voucher for your order, you must enter the applicable code during the online checkout process. You may only use one promotional code per order and additional terms and conditions may apply to each promotional code . We reserve the right to refuse any promotional code that is not valid for your order or has expired .
8. RETURNS
1. You have 14 days to return your items from the day you receive your order. This return period starts from the first day of the date you receive your order. For more information on returns, please see our return policy .
2. If you choose to return the items using a method other than one of our designated carriers ( available through our returns department ) , you will be responsible for the items, including any loss or damage, until we receive them.
9. YOUR RIGHT TO A REFUND IN THE FORM OF HAVING
1. In case of return of a product, BESSAMIM offers a refund in the form of a credit note, valid for a future purchase on our website within a period of 6 months. Here are the conditions applicable to this refund in the form of a credit note:
1. The customer has the right to return a product within 14 days from the date of receipt of the order.
2. Returned product must be in its original condition, unworn and undamaged , with all original tags and packaging .
3. Customer must contact our customer service to request a return and obtain a Return Authorization (RA) number. Unauthorized returns will not be accepted .
4. Once the returned product is received and inspected , we will issue a credit for the amount corresponding to the initial purchase, less the delivery and return costs.
5. The credit will be valid for a period of six months from its date of issue .
6. The credit can be used for the purchase of any product available on our website.
7. The credit is not refundable in cash and cannot be transferred to another person .
8. Rm Turban Beret reserves the right to modify these conditions of reimbursement in the form of credit at any time, by informing customers in advance of any changes .
1. 1. 14 days after the day on which we receive your goods back or 14 days after you have provided us with evidence of having sent the goods back via one of our carriers; or
2. 2. 14 days after you cancel your contract.
3. . If you choose to return the items using a method other than one of our designated carriers , you will be responsible for the items until we receive them, and we will not be required to provide a refund if we do not receive the items, or if they are damaged when we receive them. In such circumstances, you should contact the carrier you used to return your items.

10. DEFECTIVE PRODUCTS
1. If you are a consumer, we have a legal duty to supply products that are in conformity with the contract. Nothing in these terms and conditions will affect your legal rights in relation to defective products .
2. If you consider that a product we have supplied is faulty or misdescribed , please notify us using the contact details set out in clause 8.2 .
3. If you discover that your product is faulty after 14 days, we reserve the right to ask for evidence, such as photographs of the fault , before issuing any refund of the price paid and /or associated delivery charges .
11. OUR RIGHTS TO CANCEL THE CONTRACT
1. We may cancel the Contract at any time by sending you a letter if:
1. you do not send us any payment on time;
2. within a reasonable time after our request , you fail to provide the information necessary for the dispatch of the Products; or
3. you fail to allow us, within a reasonable time , to deliver the Products to you.
1. We may also end the Contract in the circumstances set out in clause 7.5 or 7.6.
2. If We end the Contract for any of the reasons set out in clause 13.1, We will refund any sums paid in advance for Products We have not supplied but We may deduct or charge reasonable compensation for amounts incurred as a result of your breach of the Contract.
12. OUR COMMITMENT
1. If We fail to comply with these Terms and Conditions , We will be responsible for loss or damage suffered as a result of Our breach or failure of care and skill , but We will not be responsible for any loss or damage that is not foreseeable . Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the Contract was entered into, We or you knew it would happen.
2. We only supply Products for domestic and private use . If you use the Products for commercial, business or resale purposes, We have no liability to you for any loss of profit, loss of goodwill , anticipated savings , business interruption or loss of business opportunity .
3. We do not limit in any way our liability for death or personal injury arising from our negligence , for fraud or fraudulent misrepresentation or for any situation for which We cannot limit your liability under applicable law.
13. EVENTS BEYOND OUR CONTROL
1. We will not be liable for any failure to perform, or delay in performance of , any obligation under the Contract that is caused by an Event Outside Our Control . An Event Outside Our Control is an act , event , omission or accident beyond our reasonable control .
2. If an Event Outside Our Control occurs that affects the performance of our obligations under a Contract , We will contact you as soon as reasonably possible to inform you, our obligations under the Contract will be suspended and the time required for us to perform our obligations will be extended for the duration of the Event Outside Our Control . If the Event Outside Our Control affects the delivery of our Products, We will arrange a new delivery date once the Event Outside Our Control has ended .
3. You may cancel a Contract affected by an Event Outside Our Control if it is likely to cause substantial delay. To cancel a Contract under clause 14, please contact us using the details set out in clause 8.2 .
14. INTELLECTUAL PROPERTY RIGHTS
1. All intellectual property rights in and to the Products are owned by us or our licensors . All such rights are reserved .
15. OTHER IMPORTANT TERMS
1. Nothing in these Terms and Conditions affects your rights as a consumer under the law applicable in the jurisdiction in which you reside .
2. If We need to contact you, We will do so in writing or by telephone using the contact details provided in your order, unless you request that We contact you by another means. Where in these Terms and Conditions We refer to “ in writing ” , this includes communications by email.
3. We may change these Terms and Conditions from time to time . The Terms and Conditions applicable to your Contract are those displayed on our site at the time of your order.
4. We may transfer our rights and obligations under this Agreement to another company. We will notify you in writing if we do so and we will ensure that the transfer will not affect your rights under the Agreement .
5. You may only transfer your rights or obligations under these Terms to another person if We agree to this in writing .
6. The contract is between you and us. No other person has any rights to enforce its terms .
7. All paragraphs of these General Conditions operate independently . If any court or competent authority decide that any of them is illegal or unenforceable, the other paragraphs will remain in full force and effect .
8. If We fail to require you to perform your obligations under these Terms and Conditions , or if We fail to enforce our rights against you , or if We delay in doing so, that will not mean that We have waived our rights against you or that you have no obligation to comply with your obligations. If We waive a default , We will do so in writing and that will not mean that We will subsequently waive it.
9. Please note that these Terms and Conditions are governed by French law . If you are a consumer, this means that a Contract for the purchase of Products and any dispute or claim arising out of or in connection with it will be governed by French law , unless you are not resident in France, in which case French law will only apply to the extent that it is not overridden by mandatory laws in the country where you are habitually resident .
